Who is responsible?
Usually the duty holder is the person with responsibility for the repair or maintenance of non-domestic premises. In many cases that responsibility will be made clear, for example by a lease or tenancy agreement. In properties occupied by more than one tenant the responsibility might be agreed to lie with the owner, or shared among the tenants. Where there is no agreement at all, the duty will lie with those who have control of the premises, usually the owner.
Non-domestic premises include all industrial and commercial buildings, and will also include the common parts of some residential properties such as blocks of flats.
